FOR IMMEDIATE RELEASE Nabity Proposes Legislative Bill Requiring Expanded Disclosure of Abortion Information (January 25, 2006—Lincoln, NE) Today, three days after the anniversary of Roe vs. Wade and three days before Nebraska’s Walk for Life, candidate for governor Dave Nabity unveiled a proposed legislative bill that would require women in the state of Nebraska to receive more complete information about abortion. TheNabity founded the proposal on existing Nebraska statutes that support the right of an unborn child to life. “In Nebraska today, we have legislation that communicates that as a state, we are not in favor of women having abortions and that wherever and whenever possible we should be promoting the life of the unborn and promoting adoption as an alternative to abortion. If you look at Nebr. Rev. Statutes, Section 28-325, in subsection (2) it states that we ‘expressly deplore the destruction of the unborn’ and, further, in subsection (3) it states ‘that it is in the best interest of the people of the State of Nebraska that every precaution be taken to insure the protection of every viable unborn child.’” “In addition to protection of the unborn child,” Nabity added, “I believe our state has the responsibility of fully informing women who are contemplating having abortions of the risks, both emotionally and physically. Existing legislation states that ‘she has the right to review the printed materials described in section 28-327.01,’ and it also states that ‘The physician or his or her agent shall orally inform the woman that the materials have been provided by the Department of Health and Human Services.’ However, it is not mandatory that the physician or clinic provide information for the woman to review or hand it to her.” Nabity continued, “Now, you might be asking, ‘Why is this an important distinction?’ The reason is that many women having abortions do not fully understand the procedure, the physical destruction of the unborn child that occurs, or the physical and emotional risks that can arise from having an abortion. The experience can emotionally scar and torment a woman for life. Women also do not always understand the wonderful options available as alternatives to terminating the lives of their unborn children.” “It is for these reasons that my first act as governor of the great state of Nebraska will be to introduce new abortion information legislation,” Nabity said. “The legislation will modify current law and require that any woman seeking an abortion must be personally supplied with, not only a revised booklet including all of the new facts available, but also a video and a Web site address where she can watch an on-line program. This material will provide full disclosure of the all of the elements and effects of abortion, as well as information about alternatives through adoption.” “The removal of an unborn child is not like removing a gall bladder or fixing a hernia,” Nabity said. “It is serious surgery that brings with it life and death decisions, as well as great emotional and physical risks that can forever alter the life of the woman involved. The decision involves the lives of two people, one of them totally innocent.” “Our current laws allow information about abortion to be left on the shelf, instead of being placed directly in the hands of a woman for review,” Nabity explained. “This new legislation will significantly increase the opportunity for women to have a better understanding of the impact of choosing life and adoption over abortion.” “The intention already exists within state law to provide women with information about abortion,” Nabity said, “However, the information is not likely to actually get into the hands of the women who are facing this difficult moment in their lives. It is up to us to protect the women of this state from making what could be an irrevocably devastating decision.
